Staying at Aquila Hamilton Island

The use of the AQUILA  website shall be subject to the following terms and conditions.

AQUILA does not warrant the accuracy, completeness, suitability, or reliability of any information, service or product listed at AQUILA. Under no circumstances, including negligence, shall AQUILA be liable for any loss, claim, or any direct, indirect, incidental, special or consequential damages (including but not limited to lost profits or lost savings) which arises out of or is in any way connected with the use of any information, any listing of any data at AQUILA or any delay or inability to use this web site whether based on tort, contract, strict liability or otherwise.

Deposit: A deposit of 20% of the total cost will be required to secure the booking within 7 days. If the deposit is not received within 7 days of your booking, the booking may be canceled without notice. The balance of payment is due 30 days prior to arrival. A security bond of $2000 is required. A credit card authorization will be completed on arrival with the Property Manager. Visa, Mastercard & Amex only.

Terms Regarding complimentary Golf Buggies.

  • The Buggy is supplied ” as is ”  Aquila is not liable to compensate you for the unavailability of the buggy or for any defects or breakdown in functioning of the buggy regardless of cause.
  • You have the right to use the buggy as a licensee with the right to be revoked without prior warning if you contravene any terms of this agreement.
  • The buggy will only be driven by an adult within full valid drivers licence, recognised by the Queensland Government ( no learners license accepted ), who is nominated as a driver in the booking agreement. Only nominated drivers are permitted to operate these buggies.
  • You agree to drive the buggy ( and will require any other designated driver to drive the buggy ) in a safe and reasonable manner and in particular following and abide by all Queensland Road Rules: www.tmr.qld.gov.au/saftey/queensland-road-rules.
  • This buggy is licensed to carry NO more than four person and the use of seatbelts are compulsory at all times. Please notify the Aquila property manager if a baby seat is required for the booking.
  • Any cost incurred as a result of damages to the buggy, persons or property is the responsibility of the driver.
  • Any accident or fault should be reported immediately to the Aquila property Manger who is on call 24/7.
  • Replacement charge for damages or loss of ignition key is $150
  • You agree to recharge the buggy daily or overnight as explained by the property manager. Towing/call out fee due to an uncharged flat battery will be charged back tho the driver.
  • You agree to indemnify Aquila against any loss or damages arising out of: any damages to the buggy or Property, any injury to or death of any person and damages to your property or the property of any third party and any consequential loss, cost ( including legal ) or expenses of any kind during the use of the buggies.
  • The buggy will not be permitted to be driven between the hours of 1:00am & 5:30am abiding by the Hamilton Island Enterprise rules and regulations.
  • The cost amount of any indemnity in this clause may be deducted from your security deposit and the surplus ( if any ) must be paid on demand.

Cancellations & Amendments Policy:  All cancellations & amendments must be requested through res@aquilahamiltonisland.com

    • Bookings cancelled 90 days or more to arrival are subject to a cancellation fee of 10% of the total booking cost.
    • Bookings cancelled 60 days or more to arrival are subject to a cancellation fee of 20%of the total booking cost.
    • Bookings cancelled 30 to 60 days prior to arrival will incur a cancellation fee of 50% of the total booking cost.
    • Bookings cancelled 30 days or less prior to arrival will incur a cancellation fee of 100% of the total booking cost.
    • Bookings cancelled due to government travel restrictions or closure of international or state borders shall be entitled to a credit voucher for the booking amount paid. If a refund is required a $500 admin fee will be deducted.
    • No-Shows shall not be entitled to any refund or credit voucher.
    • We will endeavour to accommodate date changes but guests that arrive late or depart early shall not be entitled to any refund.
    • Specific conditions may apply for the festive period.

Currency: All prices displayed on this website are in Australian Dollars (AUD) and all transactions are processed in AUD.
